5th Circuit Stops Big Tech Censorship in Texas

There has been a major decision made by the 5th Circuit Court of Appeals regarding Corporate censorship of speech. The corporations being outfits like Facebook, YouTube, and Twitter. In a nutshell the court ruled that these companies amount to “Common Carriers”, much like all public utilities, and therefore can be regulated as such. Including Texas passing a law prohibiting censorship due to political preferences. The following article at American Thinker describes the basis of the law and the court’s ruling:

This issue has caused a lot of angst here at SUFA in the past. The dilemma of what happens when private companies start censoring people as opposed to when the Govt. censors folks. The latter has always been taboo, to most here, but the former created a conflict of sorts. How can you defend private property or the rights of individuals then ask Govt. to regulate companies ability to control their platforms.

I agree with the author of the AT article in that given existing laws it is probably the correct answer. Because it is in fact consistent with other laws and Govt. actions over the conduct of private lives. Demanding businesses provide service to anyone and everyone, for example. No matter whether the business owner agrees with the customers values or outward appearance.

Then there is the issue that the Tech. Companies created in their own arguments. Making the case they are the location of “public discourse” to gain monopoly market share then doing an about face with respect to free speech. What was missing from this case was the interwoven nature of Govt. working with these Companies these past two years. Maybe even more but we don’t know for sure.

We should recognize here that media companies that have national audiences, we call them MSM, have a long history of working as the Govt’s propaganda arm. At least until things go south. Then they act all righteous while putting the screws to the same Govt., whose boots they were licking only months before.

I am sure many of us will celebrate this decision. But let me ask a question. How long before the other side figures out how to use this ruling against the very thing we want protected? When will the lawsuit or LAW come regulating a Company’s ability to contribute to political campaigns because it is a “common carrier”, and as such supporting one view is defacto censoring the other view. When will laws be passed or judges rule that companies MUST provide equal time to all sides of an issue?

Maybe this will turn out to just be a reasonable decision, with no unforeseen negative impacts. In the current state of political affairs, not likely.

So for now I think I will place this decision in the category of “be careful what you ask for.”

  2. Everything he said was reasonable. What I’ll never understand is the duplicity of the Democratic Party claiming their fear of losing democracy when they continue to abuse it with superdelegates. It’s really no different than states declaring certification of election results null and void and allowing a partisan Congress to overturn the votes of the people. ZERO difference.

    And you were right about Martha’s Vineyard and the political stunt pulled there when after all their “care” in front of the cameras didn’t mention the fact those poor people/pawns were shipping to a military base and off that elite island. My wife and I were just watching another bogus story about how wonderful the migrants were received and both of us said, “Yeah, right.” If SK is counting, that’s 2 or 3 times I’ve admitted I was wrong. 🙂

      • One how would be to provide armed guards around voting polls so the morons in the militias and others don’t get to threaten poll workers for doing their jobs. I know the Gravy Seals are big on intimidation, yet all they do is stand around as if they’re waiting for a war, but it does intimidate people trying to a job. Those slobs, some heavier than myself (and I’m no twiggy) couldn’t run a quarter of a mile, but they are festooned with battle gear that makes them look like a joke. I suspect one shot in their direction from law enforcement that isn’t racist or ego driven and they’d disperse with extreme prejudice. 🙂

        • We encounter militia groups all the time on the border. Most have proven to be wannabe rejects from military service that could not serve. They adorn themselves in military garb ordered off the internet….patches, rank insignia, etc. we just run them off. Can’t arrest them unless they do something wrong but we just run them off or prosecute them in the same way as illegals on private property. We charge them with criminal trespass if they are on posted land.

          They are not invited by the ranchers nor us. Can’t confiscate their weapons unless they are used improperly. We can arrest them for drinking and drug use when uninvited and trespassing but that is about all. They like to walk around small towns dressed up but nothing illegal about that unless we catch them under our “stolen valor” laws for wearing paraphernalia they are not supposed to be wearing or depicting themselves as veterans when they are not.

          • Good on you, Colonel. That is truly good news. I do think, however, there should be laws enacted that preclude them carrying weapons into state houses (as they did in Michigan). When I see shit like that, I think it’s just a matter of time before an actual gun fight breaks out.

            • Also, one of the more emotional yet factual moments during the 1st January 6 hearing was learning how poll workers were harassed to the point of some gaining entry to their homes. All in Fulton County reportedly quit, which was obviously the aim of the intimidation. And all of it because a pathological liar who had claimed back in 2015 that if he lost the election would be stolen, repeated the lie when he actually lost. Too many people are too fucking stupid to procreate is how I look at it.

            • No law is necessary for this,…..just post it outside. You can carry a weapon anywhere in Texas unless it is posted on the establishment. Texas does not require a license to carry any longer. But, if you are licensed then you can carry anywhere. I maintain my CCL just for that reason. However, you can carry a long gun anywhere.

    • Sparty losing is the second thing I was not expecting this week. Turns out its my turn to entertain COVID. Just found that out this morning after feeling bad most of the week. The test was worse than the disease. Actually put me to tears. Thats the first and last time I will ever allow that to happen. I honestly think that doctor had an attitude that I am not vaxxed so he fixed me.

      • I didn’t see the Sparty game but did watch PSU. Early on I thought they were going to have trouble but it soon became apparent that they had the game.

        Some doctors act like mini gods. My wife’s doctor once accused me of practicing medicine w/o a license because I was pulling her off some of the meds they were feeding her. She was taking over a dozen pill some to control symptoms cause by the previous pill. I weened off several of them over several months and watch carefully for any negative signs. None appeared so I assumed the drugs were counter productive if not harmful. I do I observed definite increases in Parkinson-like symptoms when she started some of the meds and commented on it. The docs just ignored me. Seems strange to me sometimes, your with the patient nearly 24 hrs a day every day and they are with them for at most 30 minutes, but your observations are discounted.

It lets you stand on a moral high horse, ignore any nuance or complication, and proclaim yourself to be the champion of the children. You need not sacrifice your weekend to work in a soup kitchen or dirty your hands. You need not change a thing about your own life to hold this stance.     I am, of course, no Christian. And were I to profess Judaism, it would only be a tepid sort. But there is morality to be gleaned here. More to the point, I would point at the above and ask this: who amongst you is undeserving of mercy and kindness that you should be treated as pawns for political benefit for the perceived crime of seeking a better life?

    The question for those of you who do profess such a faith is this: how can you reconcile your stance on the treatment of “illegal immigrants” with the foregoing? I surely could not. Do you believe Jesus would praise or criticize this treatment?

Or, there are ranchers sending their own messaging and it appears to be working for now…this past Friday a rancher and his foreman, while riding their fence line, watched 2 smugglers approach their fence line, cut the wire and appeared to signal what was considered a group of illegals waiting on the other side.(This was not confirmed) The smugglers cut the fence right next to the blue fence pole and the sign that warned them. I’m sure it was a message to the land owner that they are coming anyway….

    The minute the 2 smugglers stepped onto the private and posted property, they were intercepted and “kneecapped” with a 40 mm Glock. Both men shot in both knees. When questioned, the rancher said that he did not want to kill anyone as yet but he did send his own message back. The rancher was not charged with any crime. He was protecting his property.

    I wonder how this will turn out…..

            I like to think that I am just and moral…..for the most part. But I do not believe in the adage of “turning the other cheek.” I have always found that if you turn the other cheek..it gets slapped.

              • Again, sir….the only wrong is the unlawful side of it. I have empathy. It is hard not to have empathy having traveled the world over and seen what the other countries are really like. People here have no idea.

                But, and this is me talking, empathy is an emotion. Emotion clouds the mind. Even Mathius, when he travels to Mexico, has seen the poverty that exists there just driving to and from the airport. Mostly hovels and shacks and barefooted children begging for a single peso. Even the Indians, the original inhabitants of Mexico, are even more mistreated than anything we did with reservations and such. Every time I go to El Centro in San Miguel and I go to the square and see the begging on the church steps…..the skinny little boys and girls that beg pesos….and when you give some, they immediately run across the square and give the pesos to the FAT assed father sitting on his fat butt in the shade drinking his tequila. It is hard not to have empathy…but it must be over looked. It is a wasted emotion.

                I am not wronged by any of the persons looking for a better life until they violate the law or until they do something to me by breaking the law.

  11. DPM….you do realize, do you not, that if we stepped back and opened the borders completely and said, Come one come all, it will not end the plight of the immigrant? They will still have to pay$5k, they will still be raped and beaten, they will still be sold into sex slavery, and organs will continue to be harvested.

    You do realize this, yes? The border is under the complete control of the Cartels. COMPLETE. There is a 5 km zone that the Mexican Army or the Federales will not enter. You understand this?

      • All that you say is true….but you are missing that drugs, while still the main source of their income, is not the sole source of income any longer. It is human trafficking, the sex trade, and the new thing of organ harvesting. I have nothing to back the figures up yet as I get my information from briefings on a weekly basis. I am told (not confirmed) that drugs are only about 65% of the income. I know about prohibition and I know about cigarettes and alcohol.

        I wonder about drugs….you made mention of black market but Colorado seems to having a hell of a time with the black market now. The revenues that they expected did not materialize and I hear ( not confirmed ) that the cartels are buying up the distribution centers.

        Oklahoma has several cannabis tents and kiosks set up just across the border on I 35…They have all of a sudden, been burned to the ground. Again, (rumors) Cartels are destroying and setting up their own distribution centers. this controls supply and price. You and I both know the government will not stop this…it lacks the “juevos” to do so.

        I suggest things have changed significantly since the prohibition days.

              Is it your opinion that, given the choice between (A) “services” by an unwilling party that is both physically and legally more dangerous as well as, probably, more expensive and (B) similar services by a consenting party that is not dangerous, does not expose one to legal jeopardy and, probably, costs less… that people won’t switch to (B)?

              Maybe some subset of deviants remain with (A), but the more switch to (B), the harder it is for the cartel to justify their continued operations within (A).

              Ultimately, what I’m getting at here is the fact that people want sex. And some are willing to buy it. This is the oldest business in the world and ain’t goin’ nowhere. By forcing would-be-ethical consumers into dealing with an unethical party, you force the flow of funds to that unethical party.

              Starve the Beast ™ works for cartels just fine. Choke off their flow of funds and they weaken overall. Would you prefer to fight a cartel with a virtually-unlimited river of drug, coyote-ing, and sex-trafficking money? Or one that only has the resources of sex-tracking?

              Would you rather go to battle with a well-funded enemy with a diverse pool or resources, or one with narrow sources of funds and limited resources? You might (rightfully) think that the resources they do have are problematic, but ceterus paribus, it’s still better that they have fewer other-sources, no?

              • Is it your opinion that, given the choice between (A) “services” by an unwilling party that is both physically and legally more dangerous as well as, probably, more expensive and (B) similar services by a consenting party that is not dangerous, does not expose one to legal jeopardy and, probably, costs less… that people won’t switch to (B)? From the documents that we capture and the interceptions of cell phone conversations we capture, this underage thing is big and worth the risk to these scumbags out there. Next time you watch the news of buses unloading in New York….count the ones coming off the bus. Families are one out of 8 coming off those buses….and they ARE NOT vetted.

                Last night I was riding shotgun on a chopper flying 300 miles of border. It was a sight to see wearing NVG’s…….Apparently the word is getting out about the ranchers now defending their own fence lines without fear of prosecution. The amount of crossings into those ranches (approximately 214 miles of it) the crossings have dropped by 70 to 80%. They, the persons seeking illegal entry into the US (better?) are being channeled into the areas we want them. Choke point is the military terminology. I saw three areas where the crossings were in the hundreds…one area had 224 crossing. In this area, of the 224 crossing, there were 7 females, 9 children…….that is it. I have not seen the numbers on the other crossing yet.

                Want to stop all of this and want to stop the Cartel? Take the war to them. Close the border and turn us loose. We know where all the assembly points are. We know where the drug labs are. We know where the overseas drugs are coming in and we know who is supplying the drugs. We know the routes the Cartel takes. We need to tell Mexico to stop it or get used to seeing US flags crossing the border to do the job.

                What is wrong with this approach? Please do not tell me that it would be war with Mexico….we are already there. If we take fire from across the border, we fire back now. So….why not take the fight to them?

It will provide jobs, no matter the level of wage, and it will lead to more independence from the Eu and Russia. I understand that government needs taxes and have no problem with taxes. Reasonable taxes that promote defense and economic progress and not regressive taxes. So, no, I have not changed my position on the bailouts of corporate power…such as NO taxes, bankruptcy laws, etc. A 19% corporate rate is what will be retained in the UK. But the biggest issue that I see is the broadening of the tax rate to include more persons. I have long said that NO ONE should get a free ride. Every one, even the poor, should have skin in the game. It may not be much but it is something. I am not a believer in the VAT and she is leaving that in place and corporations pay a much higher tax on the VAT for their inventory. So, I see her policies as incentive to increase production…which has all kinds of value to the poor.

I standardized ALL light fixtures and ordered replacement bulbs (LED and fluorescent) by the gross. Commonality saves big bucks in the end. I wonder, DPM, I spent a couple of hours last night scouring the archives….I have seen no diatribe against this administration about the over 200 flights of migrants by the Federal government to cities all over the country. They are still continuing today. We count them from Del Rio, San Antonio, Laredo and Brownsville.     No one mentioned the 50, thousand housed under the bridge in my area of Del Rio last year. As to the families that are coming here…..no objection to them as long as they are legal….I have a huuuuuuge problem with the non vetting and letting in single males that are remarkably dressed and carrying new back packs and new Nike clothes and such coming from such a supposedly impoverished country.

            Being down here and working the border directly, you start picking up on little items. Look at haircuts, the types of clothes, shoes (especially shoes) the style and newness of back packs…about half of them don’t even have the sales tags taken off. Look into their eyes….you can tell a lot about that. You can pick out the really bad guys pretty easily but there is no vetting, despite what the lying ass media says, there is no vetting. I personally see this. I know where they go when we catch them and I know what happens to them. Those that have proper identification actually turn themselves in to the authorities. They do not try to sneak by. The ones wearing camouflage and run from you are not only dirty but usually are carrying drugs…we are lowering the got away types because we can now pursue them and catch them The National Guard now has arresting powers.

So they would need to focus on “a rising tide lifts all boats” rather than the current unofficial motto of the US economic modus operandi: “screw you, I got mine!”

        It would be a painful adjustment for people used to screwing others for their own benefit. But the end result would (eventually) be better for everyone.

          1. You have no right to “allow” human beings to move freely. They are not your property. America is not your private property, either. They don’t NEED your permission.

              • Well, sir, good question. In as much as I was not a protester and in as much as I was not a draft dodger and in as much as my lottery number was 22…I was going to be drafted. I was a college graduate and not eligible for the deferment any longer. So, my best friend and I decided to volunteer to pick what we wanted. We went on on the buddy system which was available back then…went through basic training and towards the end of basic training, some special forces recruiters came by and boy did they look sharp. Hero badges (ribbons) green beret, shined jump boots….the works. Female bait, as we referred to them (cannot say that today). So, we volunteered to go through special forces training….we mistakenly thought that the war was winding down (this was 1969) and we thought that with the extra training, the timing was right….but alas, Nixon decided to prolong the war. At the end of our training, off we went. Unfortunately, I came back in pieces and Rick, my best friend, did not make it. He died in my arms hunkering down behind a five foot tall four foot wide termite mound. I could not save him and the first med evac coming in was shot down. All this to say, it was volunteer or be drafted any way.

                I might add that prior to my lottery number being pulled, I had qualified for my Class A touring card for the PGA. After being wounded the first time, I volunteered for a second tour and got even more hurt 6 months into it. Was then sent to Japan to rehab and have some ligaments and bone replaced from a mortar that almost severed my leg. I am ok now but feel it when it comes on to rain. I have 90 function and can dance with my spousal unit. I was lucky…I do have a baboon ligament in my knee put in while in Japan because the Medical association in the US would not authorize surgery with baboon ligaments. I feel pretty good now and do not need any type of device.

                I still play golf but I lost my competitive edge while over seas. It took me awhile to recover and making the tour was a young mans game.

                Now, I will take it further because it is important to know why I am a Colonel and stayed in the reserves for so long..When I got home in 1974 from rehab and earned my first Masters in finance, I could not get a job anywhere because I was a Vietnam Veteran. I could not even get a job pumping gas. My family had a very successful business but I was young and wanted to not be dependent upon them. So I tried to go on my own without help. I lost all my friends because I volunteered to go and did not run off to Canada. I confess that I was fortunate and grew up in a wealthy family that was very connected politically as were most of my friends. Jim Wright was the Speaker of the House back then and I could have used political connections to get out of the war. It was offered but I chose not to. This, of course, upset my parents but I did not want to use family money nor connections. So, I chose to not avoid the draft. That is for cowards and I am far from being that. I earned my second Masters in International Finance but could still not land a job anywhere because of being a Vietnam Veteran. So, I stayed in the Reserves and drew a partial salary there and started my own business…..

                I joined the family business in the 80’s after being asked to take over the finance position when my predecessor retired. Over the years, I have learned all facets of the family business. In the meantime, much to the chagrin of my parents yet again, staying in the reserves, I did combat duty in Desert Storm (Kuwait), Bosnia, and Afghanistan until I got passed over for Brigadier General three times because I was not an Academy Graduate.

                That is pretty much my history. I had a great military career even though the majority if it was reserve duty. I volunteered for combat duty in Bosnia, working under UN command….that was a grave mistake. Kuwait and Afghanistan were assignments as a reservist.

                Now, why the question? I thought you should know pretty much all of my military background. You can ask JAC, he has been to my house and seen what I call my war room. I have been around….so, again, why the question?

                  • Well, Kuwait was ahead of Bosnia….I am not gung ho military from the standpoint of picking my teeth with a bayonet. I went and fought because my country was there. I know it sounds cliche’. I would go fight today if Biden ordered it because he is my President and CIC….But Vietnam taught me one thing…true team work and what a brotherhood meant. we did not care about black and white…we shared blood no matter the race. We drank out of the same canteens, it did not matter. We held each other in hard times and cried together…race was not an issue with us (Special Forces).

                    How do I feel about the military today…I do not like what I see and I do not like nor support the “woke” agenda. I do not think I am a militarist….I do not have a bunker in my back yard and I do not like the militias

                    Your answer to Afghanistan….after mt stint in the Special Forces, once I made captain the pinnacle gets very narrow at the top. So I crosstrained into the mechanized forces. In Kuwait, I was a Battalion commander. I had five companies under my command. Four M1A1 tank companies and a mechanized infantry company. When the attack started I had a slice of Apache helicopters assigned to me as well as a platoon of mobile 122’s artillery. Until we were ordered stopped at the main highway coming out of Kuwait, my battalion destroyed 87 vehicles, captured 300+ of the enemy, and my only casualty was one of my tank commanders got a broken arm. That was it.

                    I had more firepower than Thor’s Hammer.

                    Being assigned to the UN shortly afterwards and going under the so-called Peace Keeping force was a huge mistake. the UN is worthless and did not stop the genocide. We were not under American Command and had to wear the fairy looking blue helmets.

                    Afghanistan was not a major deal. I was tasked with taking a mechanized Brigade and setting up a base of operations. I did not support the war in Afghanistan but it was my duty and it was my Brigade at that time. I spent only 6 months in country…just long enough to “get my ticket punched” as they say. I never saw active combat except for the occasional mortar attack. I never left my headquarters because my duty was logistics and organizing a defense of the operations area.

                  I have been ruminating on Viet-nam these last fifty years and have reached some interesting conclusions. While we probably should not have been there the way we were, uncle Ho certainly takes the cake for asshole of the century.

                  For years we have been told of the “long view” Asians take of history as in, “we won’t beat you this year but we will next decade or next century”. Uncle Ho decided that a few million of his people should die to make it happen NOW.

                  The long view of history should have convinced him that had he withdrawn North and we left, eventually the two countries would have been reunited and not necessarily by force. Of course people would point out Korea has not reunited but politically, culturally and most importantly, geographically Viet-nam is NOT Korea.

                  Uncle Ho suffered what some would call a “God” complex. Only “he” could bring about reunification. Throughout the war, we were told time and time again by the left that Viet-nam was more like Yugoslavia in terms of its relationships with China and the USSR than East Germany. They were forced into an alliance because of the nature of our involvement and the fact it tied us down. Russia and China were more than happy to have a proxy war going on much as we are with the Ukrainians. Turns out the left was correct and the tiff they later had with the Chinese proved the fact. Also turned out that the place was much more nationalistic than anyone imagined at the time.

                  Viet-nam’s post war success demonstrated what could have happened without all the bloodshed but as I said, Uncle Ho had to have it his way on his timetable. The peasants, as usual, paid the price for his megalomania.

                  One thing which still annoys me to this day is the complete black hole in our collective memory banks over the atrocities committed on a daily basis by his forces, both regular and the VC. I read Dr. Tom Dooley’s books in high school about Southeast Asia ( Deliver us from evil, The edge of tomorrow [and] The night they burned the mountain” and his attempts to serve the people of Southeast Asia through MEDICO and still remember, in vivid detail, the way the insurgents treated the uncooperative villagers.   55. They have banned the sale of gas powered tools and internal combustion engine cars. Now CA is banning the use of natural gas for heating. I do not know if this includes propane which is my primary source of heat. The push is to go to heat pumps but my experience with heat pumps in commercial buildings is they do not work in extreme weather and need constant maintenance. It also means that more people will switch to wood especially in the hinter lands. In the cites wood is already regulated if smoke levels exceed a certain value.

    I lived in farm country when young. We learned not to depend on a single source of energy. This is going to be a disaster in the making. People will die.

    These rules are coming from the CA Air Resources Board, a body of unelected bureaucrats. The legislature is not involved hence it is by royal decree.

        Listening this morning to the “unbiased” description of the Italian election, I can sort of predict, any day now, someone will accuse Meloni of being in the pay of the Kremlin and of course Il Duce’s illegitimate grand daughter.

So it comes down to gut feeling, which is against all logical thinking. But that’s where we are. I think that you guys, Mathius and Charlie, that because we are conservative, we somehow give the Rs a break. I don’t. Mathius is up on his soapbox again about Red team this and Blue team that, and he can admit that Blue team sucks so that absolves him of any other criticism. Try to present an opposing view and we get labeled whatever you come up with out of your hats. That’s called silencing the opposition, and that’s not fair debate.

            Guess what guys? We all think the same. Our government is corrupt. Not only our government, but all governments. What else have we been talking about for over a decade? All three branches are guilty. All three cover…or compartmentalize… info from each other, to where nobody trusts anybody anymore. We argue about what to do about it. Spare me the righteous indignation.

            Meantime, what is so wrong about America First and small government? We really don’t have much choice anymore.

            “The Archives” are commonly understood to reside in Washington D.C.. The Presidential Records do not have to reside in D.C.. They simply have to be under the control of the Archivist. Hence my comment in the prior article that we have never seen any documentation of conversations between Mr. Trump and the Archivist regarding designations or conditions of storing documents at Mara Lago.

            And one more time, there is no crime for and ex POTUS to have said documents. While it may violate either the Act or the terms of agreement between the Ex-POTUS and the Archivist, there is no criminal act described nor enforcement mechanism provided by the Act.

            This is not a rationalization or justification for Mr. Trump having said documents. It is only a statement about the law and implementing rules.

      Well, since Orange Jesus LOST the election, he was no longer part of the government. His actions as president LONG before January 6 were in preparation for a coup. He tried it, but the knucklehead revolution failed (although I doubt he ever thought it would succeed–like a brat, he just wanted to destroy everything he couldn’t play with anymore), and ALL the OVERWHELMING evidence supports the coup theory. Whether he’s ever indicted and convicted is just another shining example of our shit hole of a country on a hill of the wealthy by the wealth and for the wealthy. If he’s not indicted AND convicted, it’s just one more example of a government corrupt to the core protecting it’s future wealthy class.
